Trust cinema – Elahe Qadri, a basic lawyer of a court of justice and Sidamir Parvin Hosseini’s lawyer, producer of the movie “Don’t be ashamed 1 and 2”, told ISNA when announcing the news of legal prosecution against people who illegally exploit this work of art: According to Article 23 “According to the Law on the Protection of the Rights of Authors, Authors and Artists, any publication, broadcast or presentation of a work without the author’s permission is considered a crime, and violators will be prosecuted.”
On the eve of the online screening of the movie “Don’t be ashamed 2” on Filmnet, this lawyer announced that a sentence of one and a half years of imprisonment awaits these people, adding: “The movie “Don’t be ashamed” as a cultural and artistic work with rich content deserves legal protection. and any unauthorized action in the use of this work not only damages the material and intellectual rights of the creators, but also damages the cultural economy of the country. In this regard, we will use all our legal possibilities and will do the necessary follow-up.
He also pointed to the issue of rights violations of theatrical works on film screening platforms and added: Unfortunately, some screening platforms have placed the film “Don’t be shy” on their screening platform without the permission of the owner of the work. These platforms, sometimes with the extensive support of the institutions that should monitor the correct implementation of the law, have caused serious damage to the investors of Iranian cinema without creating proper monitoring to prevent the unauthorized distribution of works. Also, some government-affiliated institutions, instead of helping the cinema industry, have entered into contracts and broadcast films beyond their contract period, which caused significant damage to film investors with this neglect. Unfortunately, the existing legal and legal structure regarding works of art, as well as the judicial procedure, is such that it practically does not provide the ability to recover the damages caused to the investors in this way. Many investors give up pursuing their legal rights, despite the severe damages they have suffered, due to the knowledge of the futility of legal pursuits. With this situation, many investors will leave the cinema field and the result of this withdrawal will be the fall of the private sector cinema in Iran.
In the end, Elahe Qadri emphasized: We request the cinema fans to support the domestic productions and respect the rights of the authors, to help the growth and elevation of the country’s art. Respecting the rights of the creators of artistic works should be institutionalized in the society so that in this way, the Iranian cinema industry will achieve more prosperity.
